OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards due to unanchored storage racks. On or about December 21, 2016, employees were exposed to struck-by and crushing hazards due to damaged storage rack systems throughout the warehouse while moving product on the racks. The employer failed to ensure that all column base plates were anchored to the floor with anchor bolts. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.22(d)(1): Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition. On or about December 21, 2016, employees were exposed to trip/fall hazards while walking on a chemical mezzanine due to the mezzanine having an uneven/worn surface and missing clips. The employer did not ensure the walking/working surface was maintained in a safe condition. No abatement certification or documentation is required for this item.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. On or about December 21,2016, employees were exposed to struck-by and crushing hazards due to damage of the uprights on multiple storage racks located throughout the warehouse caused by forklift accidents and/or near-misses. The employer did not conduct refresher training for the operator(s) involved in the accidents or near-misses, which included an evaluation to ensure the operator(s) had the knowledge and skills needed to operate a power industrial truck safely. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
