29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: a. On or about January 5, 2017, at the facility located at 4303 Bayshore Drive Sturgeon Bay, WI, the employer did not have a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures to protect employees exposed to chemicals such as Hydrogen Chloride solution and Sodium Hypochlorite solution. All provisions of 29 CFR 1910.134(c) through (o) must be covered in a respiratory protection program. Key elements include, but are not limited to the following: 1. Selection of respirators for employees. 2. Medical evaluations of employees. 3. Fit testing. 4. Training and information. 5. Recordkeeping.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: 1. A list of hazardous chemicals known to be present. 2. The methods the employer will use to inform employees of the hazards of non-routine tasks. a. On or about January 5, 2017, at the facility located at 4303 Bayshore Drive Sturgeon Bay, WI, the employer did not have a written hazard communication program that included employee training on methods to protect themselves from exposure to chemicals such as Hydrogen Chloride solution and Sodium Hypochlorite solution.
