29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  On or about 1/10/2017, employees working at Shippers Rental Company, doing business as Bear Creek Warehouse, were operating forklifts without having operators performance evaluations performed at least every three years.  The company had not performed any evaluations on their forklift operators.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  On or about 1/10/2017, employees at Shippers Rental Company, doing business as Bear Creek Warehouse, were operating unsafe powered industrial trucks in need of repair and were not removed from service.  The following forklifts were on site and not removed from service:  a)            Komatsu Forklift #125; the LPG tank indexing/locator pin was missing  and the LPG tank was installed incorrectly. b)            Doosan #202272, the LPG tank indexing/locator pin was missing and LPG tank was installed incorrectly. c)            Doosan #194513; the LPG tank indexing/locator pin and bracket were bent and damaged. d)            Doosan #192948; the LPG tank indexing/locator pin and bracket were bent and damaged. e)            Doosan #202275, the LPG tank indexing/locator pin and bracket were bent and damaged.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.  On or about 1/10/2017, employees at Shippers Rental Company, doing business as Bear Creek Warehouse, were operating unsafe powered industrial trucks that were not in safe operating condition.
