29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: (a) Residential construction located on Lot #8, Cut bench: On or about January 11, 2017, and at times prior, the employer exposed employees to eye injuries while cutting cornice board materials and siding, in that protective eyewear was not provided or used while operating Makita (Model 5007F) 7-1/4-inch circular saws. (b) Residential construction located on Lot #8, Pump Jack scaffold system: On or about January 11, 2017, and at times prior, the employer exposed employees to eye injuries while operating nail guns at 130 PSI while installing siding and cornice boards, in that protective eyewear was not provided during installation.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: (a) Residential construction located on Lot #8, Cut bench: On or about January 11, 2017, and at times prior, the employer exposed an employee to amputation hazards while cutting cornice board material with two circular saws without the lower guard in place, in that the saw operator used a shim to prevent the lower guard from retracting after the a cut was made through the siding and cornice materials.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) New residential construction located on Lot #8, Front side of structure on pump jack scaffold: On or about January 11, 2017, and at times prior, the employer exposed employees to fall hazards of approximately 30 feet from the pump jack scaffold work platform to the lower level, in that personal fall arrest was not provided to employees installing cornice boards and siding.
