29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.  On or about January 12, 2017, employees performing framing operations on the second level of a residential property were exposed to a fall when the top of a 6 foot Werner A-frame stepladder was used for access/egress to the second level.  The employer did not ensure the top of the stepladder was not used as a step.    No abatement certification or documentation is required for this item.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  On or about January 12, 2017, employees performing framing operations on the second level of a residential property were exposed to a fall when incorrectly using an A-frame stepladder to access/egress the second level.  The employer did not ensure the employees were  trained to recognize hazards related to ladders.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   Employees are exposed to fall hazards while engaged in construction activities 6 feet or more above lower levels.  The employer does not protect each employee by means of a guardrail system, safety net system, or personal fall arrest system.     The following instance most recently occurred January 12, 2017, at the above addressed jobsite:    Employees engaged in framing operations on the second level of a residential property are not protected against a fall, thereby exposing employees to a 10.6 foot fall.    To abate this hazard in the future, the employer must ensure that its employees performing residential construction activities are protected from falls, and that no employee is exposed to a six foot fall or greater without adequate fall protection. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
