29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about January 20, 2017, the employer failed to establish a Control of Hazardous Energy program and train employees so as to ensure the safe performance of servicing and maintenance of the Woodpecker nailer machine which has electrical and pneumatic energy sources.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about January 20, 2017, the employer failed to provide adequate guarding on the Woodpecker nailer machine to protect employees from point of operation hazards. Employees who operate this machine are within approximately 12 inches of the point of operation where the nails are mechanically impaled into the wood pallets.

29 CFR 1910.213(g)(4): Inverted swing cutoff saw(s) were not provided with a hood which covered the part of the saw that protruded above the top of the table or above the material being cut and automatically adjusted itself to the thickness of, and remain in contact with the material being cut: On or about January 20, 2017, the employer failed to ensure that there was effective guarding in place on the pop up table saw (no name or serial number as it was made by the employer and is the only one in the facility) located in the upper shop area. When the employee feeds wood pieces of various sizes into the saw, 10 or more inches of the 22 inch saw blade are exposed.
