OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to a fall hazard: When employees were lifted up to approximately 11 ft. by a forklift while standing on a pallet set on the forks. Among other methods, one feasible and acceptable means of abatement would be the use of an engineered man basket designed for being lifted by a forklift or some platform designed for being lifted by a forklift while the employee lifted wore personal fall arrest equipment.

29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: When employees were lifted up to approximately 11 ft. by an order picker to unload or retrieve tires, an available harness was not worn. (Note: body belts are no longer allowed for fall protection use. A harness must be used.) Abatement documentation is required for this violation.
