29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about January 24, 2017, during water mitigation and content cleaning work, the employer did not provide a medical evaluation prior to requiring employees to wear respirators. Employees were required to wear respirators when entering the primary containment area.

29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations: On or about January 24, 2017, the employer failed to perform an engineering survey for the demolition and water mitigation work in the basement level of the Pleasant Valley church. The damaged was caused due to flooding and sanitary sewer damage and the work included the dismantling, razing, and/or wrecking of the basement walls.

29 CFR 1926.850(e): It had not been determined if any type of hazardous chemicals, gases, explosives, flammable materials or similar dangerous substances had been used in any pipes, tanks, or other equipment on the property. The presence of such substances was properly evaluated to determine the presence before demolition was started: On or about January 24, 2017, the employer failed to determine the presence of any hazardous substances prior to allowing demolition work to begin. The employer does not perform any type of survey to determine the presence of any hazardous substance on any demolition jobs prior to starting work.
