OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught-in-between the ground surface and the rollover guard canopy in the case of a tip over:        a)  On or about 1/26/17 in the main fabrication shop, employees were not protected from caught-in hazards when operating a Caterpillar, Model 2P5000, Serial # AT3532079 powered industrial truck without using the seat belt.
