29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. For the employees climbing the supported scaffold frames to access the working platform on or about January 25, 2017, the employer did not provide a ladder that meets the requirements of 1926.1053. This exposes employees to falls while climbing the scaffold frames to access working platforms on the supported scaffold.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity). For the employees performing overhand brick laying from the third tier of tubular frame scaffold on or about January 25, 2017 and times prior there to, The employer did not provide fall protection at each open end of the working platform. This exposes employees to falls from the scaffold.

29 CFR 1926.706(b): Masonry walls over eight feet in height were not adequately braced to prevent overturning and to prevent collapse until permanent supporting elements of the structure were in place. For the employees working around the south wall being erected with concrete block on or about January 25, 2017, the wall under construction was approximately 12 to 20 feet high and 60 feet with no bracing on the opposite site to prevent collapse. This exposes employee to the hazard of being struck by falling masonry blocks.
