29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or an equivalent dose of fifty percent:    On or about February 2, 2017, the employer did not administer an effective hearing conservation program that included noise monitoring, required use of suitable hearing protectors, training, audiometric testing, and recordkeeping for the following:    a) an employee washing trailers was exposed to a continuous noise level of 91.3-percent of the permissible daily noise exposure, or an equivalent sound level of 89.3 dBA, during the 280-minute sampling period; exposure calculations include a zero increment of 200-minutes not sampled.    b) an employee washing trailers was exposed to a continuous noise level of 72.7-percent of the permissible daily noise exposure, or an equivalent sound level of 87.7 dBA, during the 289-minute sampling period; exposure calculations include a zero increment of 191-minutes not sampled.

29 CFR 1926.451(b)(1)(ii): The platform was not planked or decked as fully as possible and the remaining open space between the platform and the uprights exceeded 9.5 inches (24.1 cm):    On or about January 30, 2017, employees working at the trailer drive lane station used to tarp rendering trailers were provided:    a) yellow tubular scaffolds (East side) and there was approximately 18-inches of space between the two 12-inch wide aluminum planks and the outermost uprights.    b) brown tubular scaffolds (West side) and there was approximately 24-inches of space between the 20-inch wide planks and the outermost uprights.
