29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. On or about February 1, 2017 and times prior, thereto, at the workplace located at 6725 Hilo Drive Benton, Arkansas, employees were required to work picking-up metal roofing scraps without protective helmets. This condition exposed employees to the hazard of being struck by pieces of metal being thrown from the roof.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On or about February 1, 2017 and times prior thereto, employees were on a roof at a residential construction site at the height greater than 6 (six) feet at 6725 Hilo Drive Benton, Arkansas. The employer did not ensure employees were utilizing fall protection, exposing them to the hazard of falling from the roof.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about February 1, 2017 and at times prior thereto, at a construction site located at or near 6725 Hilo Drive Benton, Arkansas, employees were installing a metal roof using screws and screw guns and it was not ensured they were using appropriate eye protection. This condition exposed employees to the hazard of being struck in the eye by metal screw fragments or from contacting sharp metal edges while handling the roofing material.
