OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crushed-by hazards while working from a crane suspended personnel basket: a) 400 E. Indian River Rd, Norfolk, VA 23523, Barge Alexandria, Pier 5: On or about January 18, 2017, employees were exposed to fall and crushed-by hazards while working from a crane suspended personnel basket that was not designed or constructed by qualified and certified persons, did not have a capacity rating to support its own weight and five times its intended load, did not have a safety device to prevent two blocking properly installed, activated and functioning, and was not test lifted prior to lifting personnel. Employees were injured when the wire rope holding the personnel basket broke from over tensioning dropping them approximately 15 feet to a deck below. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Indian River Rd, Norfolk, VA 23523, Barge Alexandria, Pier 5: On or before February 14, 2017, and times prior thereto, the employer did not remove and repair or replace the defective anti two-block system on the P&H Omega 20 hydraulic crane, serial number 51601, that was used for ship repair work including (but not limited to) lifting personnel and materials, exposing employees to struck-by, crushing and other hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Indian River Rd, Norfolk, VA 23523: On or before February 14, 2017, and times prior thereto, the employer did not test and thoroughly examine every 5 years as provided in 1919.15(a), a barge-mounted P&H Omega 20 hydraulic crane, serial number 51601, that was used to transfer equipment and/or materials from or to a vessel, exposing employees to struck-by, crushed-by and other hazards. b) 400 E. Indian River Rd, Norfolk, VA 23523: On or before February 14, 2017, and times prior thereto, the employer did not thoroughly examine annually as provided in 1919.15(b), a barge-mounted P&H Omega 20 hydraulic crane, serial number 51601, that was used to transfer equipment and/or materials from or to a vessel, exposing employees to struck-by, crushed-by and other hazards. c) 400 E. Indian River Rd, Norfolk, VA 23523: On or before February 14, 2017, and times prior thereto, the employer did not annually inspect or examine as provided in 1919.15(d), the barge on which the P&H Omega 20 hydraulic crane, serial number 51601 was mounted, that was used to transfer equipment and/or materials from or to a vessel, exposing employees to struck-by, crushed-by and other hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
