29 CFR 1910.178(l)(1)(i):  Operators were not trained in the safe operation of powered industrial trucks:       (a)Wiersma Construction @ 2210 W. Pentagon Place, Harrisburg, SD 57032:  On February 13, 2017, the exposing employer did not ensure all forklift operators were trained in operation of powered industrial trucks in that, an operator was  not trained in the use of the Ingersoll-Rand rough terrain forklifts prior to use. This condition exposed the employees to the hazard of improper forklift operation.       Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.   Abatement Note: The requirements applicable to construction work under 1926.602(d) are identical to those set forth at 1910.178(l) of this chapter.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  (a)Wiersma Construction @ 2210 W. Pentagon Place, Harrisburg, SD 57032: On or prior to February 13, 2017, the exposing employer did not ensure employees were protected from serious injury while using of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the rough terrain forklift manufacturer. The employer utilized the forklift platform in the construction of a fabricated systems engineered steel building. The platform was not specifically approved by the forklift manufacturer nor did it meet ASME/ITSDF B56.6-2011 requirements. The platform exceeded criteria for the overall length and did not have a data plate identifying maximum working load including personnel and equipment. This condition exposed employees to fall hazards and crushing hazards related to the platform separating from the mast.   Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ITSDF B56.6-2011, American Society of Mechanical Engineers/Industrial Truck Standards Development Foundation, "Safety Standards for Rough Terrain Forklift Trucks",  Section 8.24.1, Platforms for Elevating Personnel, in the following areas: (1)Paragraph (b) which states, "floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a length greater than the overall width of the truck measured across the load bearing tires plus 10 in. (250 mm) on either side. (2)Paragraph (f) which states, "information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform." 29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:     (a)Wiersma Construction @ 2210 W. Pentagon Place, Harrisburg, SD 57032: On or prior to February 13, 2017, the exposing employer did not ensure that employees were protected from a fall hazard in that, guardrails or other suitable fall protection was not installed on the personnel platforms connected to the rough terrain forklifts that were being used by employees to construct a systems engineered steel building. This condition exposed the employees to the hazard of a fall of 25 feet.

29 CFR 1926.760(a)(1):  Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:   (a)Wiersma Construction @ 2210 W. Pentagon Place, Harrisburg, SD 57032: On or prior to February 13, 2017, the exposing employer did not ensure that employees bolting steel purlins during the construction of a commercial steel building were protected from fall hazards. Two employees were not using personnel fall arrest systems while standing on structural steel performing this task. This condition exposed the employees to a fall hazard of approximately 29 feet.

29 CFR 1926.761(b):  The employer had not provided a fall hazard training program for employees engaged in steel erection activities:       (a)Wiersma Construction @ 2210 W. Pentagon Place, Harrisburg, SD 57032:  On February 13, 2017, the exposing employer did not provide fall protection training for those employees engaged in steel erection activities. Employees accessed and work on the steel to finish bolting purlins without the use of a fall protection system. This condition exposed the employee to a fall hazard of approximately 29 feet.         Abatement Note: The following provisions supplement the requirements of 29 CFR 1926.21 regarding the hazards addressed in this subpart.       (a)  Training personnel. Training required by this section shall be provided by a qualified person(s).         (b)  Fall hazard training. The employer shall provide a training program for all employees exposed to fall hazards. The program shall include training and instruction in the following areas:         1)      The recognition and identification of fall hazards in the work area;  2)      The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used;  3)      The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;    4)      The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and    5)      The fall protection requirements of this subpart.       (c) A qualified person means one who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems relating to the subject matter, the work, or the project.
