29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:    a) Basement Level - An employee was observed holding onto the power cord of a Flotec portable sump/utility pump, model number FP0S1300X which was pumping water and a ground fault circuit interrupter was not provided, 120 volt, 5 amp service, on or about 02/14/2017.    b) Third Floor - Employees were using a 4-way temporary outlet to supply power to portable electric tools, including a Porter-cable air compressor and a Makita circular saw, and a ground fault circuit interrupter was not provided, 120 volt, 15 amp service, on or about 02/14/2017.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:  a) Basement Level - An employee was observed holding the flexible cord on a Flotec Submersible Sump/Utility Pump, model number FP0S1300X-08 while the pump was under water and the plug was missing the ground pin, 120 volt, 15 amp service, on or about 02/14/2017.  b) Third Floor - Employees were using a job made temporary outlet to supply power to portable electric tools including a Porter-cable air compressor and a Makita portable electric circular saw and the extension cord supplying power was missing the ground pin, 120 volt, 15 amp service, on or about 02/14/2017.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Roof Level - A framer was observed standing at the top of the old roof line nailing new wooden joists and exposed to a 34 foot fall hazard, on or about 02/14/2017.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
