29 CFR 1910.28(b)(3)(i): Holes. The employer did not ensure each employee was protected from falling through any hole (including skylights) that was 4 feet (1.2 m) or more above a lower lever by one or more of the following: Covers; Guardrail systems; Travel restraint system; or Personal fall arrest system.   On or about February 2, 2017, at Forterra Pipe & Precast, LLC, the employer failed to ensure that employees were protected from a fall hazard while working near floor holes.  Instance 1) The floor hole that is  located on the North side of the pipe jacket.  Instance 2) The floor hole that is located on the South side of the pipe jacket.

29 CFR 1910.146(g)(4): The employer did not certify that the training required by 29 CFR 1910.146(g)(1) through 29 CFR 1910.146(g)(3) had been accomplished.    On or about February 2, 2017, at Forterra Pipe & Precast LLC, the employer failed to ensure that employees were trained in confined space entry. Employees entered the confined space daily to remove excess cement from the Pipe Machine PH-84.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed.     On or about February 2, 2017, at Forterra Pipe & Precast, LLC, the employer failed to ensure that a periodic inspection of energy control procedures was conducted. This condition exposed employees to hazardous energies such as but not limited to: electrical, hydraulic, gravity, compressed air and thermal.
