29 CRF 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.     A. Sunnyside LLC worksite located at 15592 John F. McCarthy Way, Perrysburg, Ohio: On or about February 22, 2017, the employer did not instruct all employees in the recognition and avoidance of hazards commonly seen in the roofing industry. Employees were not effectively trained to recognize effective and ineffective means of fall protection and ladder use.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     A. Sunnyside LLC worksite located at 15592 John F. McCarthy Way, Perrysburg, Ohio: On or about February 22, 2017, the employer did not ensure employees were protected from falls while installing weatherproofing on the North side of the two story residential structure.  The employees were exposed to a potential fall distance of approximately 16.00 feet to the lowest level.

29 CFR 1926.1053 (b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.     A. Sunnyside LLC worksite located at 15592 John F McCarthy Way, Perrysburg, Ohio: On or about February 22, 2017, the employer did not ensure the side rails of the extension ladders were extended at least three feet above the landing surface. Two employees were exposed to falls while using the ladder to access the North side of the roof.
