29 CFR 1926.20(b)(4): The employer shall permit only those employees qualified by training or experience to operate equipment and machinery.  On February 19, 2017, located inside a demolition work zone, an employee who had not been trained to operate equipment and machinery was operating a hydraulic excavator while mechanically shearing a pressurized compressed gas cylinder. Employees were exposed to struck by hazards from gas cylinder fragments that were launched approx. 1400 feet into the air.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   (A) On February 19, 2017, located inside a demolition work zone, an employee was storing pressurized compressed gas cylinders, for mechanical destruction, in a scrap metal pile that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work.    (B) On February 19, 2017, located inside a demolition work zone, an employee was mechanically shearing a pressurized compressed gas cylinder, with a hydraulic excavator, that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work. Employees were exposed to struck by hazards from gas cylinder fragments that were launched approx. 1400 feet into the air.
