(a)Lowell Cook Construction at 2203 Green St., Yankton SD, 57078:  On and prior to February 20, 2017, the employer did not ensure employees were protected from eye injuries while using pneumatic nail guns. Employees were using the nail guns while installing roof trusses without the use of eye protection. This condition exposed employees to eye injuries.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    (a)Lowell Cook Construction at 2203 Green St., Yankton SD, 57078:  On and prior to February 20, 2017, the employer did not ensure employees were protected from fall hazards while working from a wall bracket scaffolding platform that was mounted to the side of the two story building under construction. Employees were using the platform to erect roof trusses without the installation of guardrails or the use of a personal fall arrest system. This condition exposed employees using the platform to a fall hazard of approximately 17 feet.

(a)Lowell Cook Construction at 2203 Green St., Yankton SD, 57078:  On and prior to February 20, 2017, the employer did not ensure employees were provided scaffolding training by a person qualified in the subject matter to recognize hazards associated with wall bracket scaffolding. Employees were working off of the scaffolding conducting framing activities. The condition exposed employees to a fall hazard of approximately 17 feet.

The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. Employees were working at elevations up to 20 feet without the use of a fall protection system. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a)Lowell Cook Construction at 2203 Green St., Yankton SD, 57078:  On and before February 20, 2017, the employer did not ensure employees were protected from falls associated with using an extension ladder that was not extended at least 3 feet above the upper landing surface being accessed. The ladder used to access the building was extended approximately one-rung above the landing. This condition exposed employees to fall hazards associated with accessing and egressing the work area.
