29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.     On or about February 15, 2017, the employer did not ensure a Yale, Model OS030BF, Serial Number E826N01502K, High Lift Order Picker Rider Truck, known as OP3, was taken out of service when it was found the trucks lift chains needed to be replaced, causing an unsafe operating condition.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).     On or about February 15, 2017, the employer did not ensure the operator of Yale, Model OS030BF, High Lift Order Picker Rider Truck, also known as a cherry picker, had successfully completed all requirements of powered industrial truck safe operation training.        SUPERIOR BEVERAGE GROUP, LTD., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1910,178(l)(1)(i), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 527278, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON OR ABOUT 09/25/2012, WITH RESPECT TO A WORK PLACE LOCATED AT 31031 DIAMOND PARKWAY, GLENWILLOW, OHIO.
