The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. a. On or about February 28, 2017, employees were exposed to cardiovascular hazards when required to wear tight fitting respirators, and the employer did not provide medical evaluations to employees to determine the employees' ability to use a respirator.

29 CFR 1926.1127(d)(1)(i): Prior to the performance of any construction work where employees may be potentially exposed to cadmium, the employer shall establish the applicability of this standard by determining whether cadmium is present in the workplace and whether there is the possibility that employee exposures will be at or above the action level. The employer shall designate a competent person who shall make this determination. Investigation and material testing techniques shall be used, as appropriate, in the determination. Investigation shall include a review of relevant plans, past reports, material safety data sheets, and other available records, and consultations with the property owner and discussions with appropriate individuals and agencies. a. On or about February 28, 2017, the employer did not determine if cadmium was present in the workplace prior to having employees perform demolition work on material containing cadmium in a one hundred year old building.

29 CFR 1926.1127(m)(1): Hazard communication. The employer shall include cadmium in the program established to comply with the Hazard Communication Standard (HCS) (� 1910.1200). The employer shall ensure that each employee has access to labels on containers of cadmium and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (m)(4) of this section. The employer shall provide information on at least the following hazards: Cancer; lung effects; kidney effects; and acute toxicity effects. a. On or about February 28, 2017, the employer did not include cadmium in the Hazard Communication Standard training provided to employees who were exposed to cadmium while performing demolition work.
