29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On the north side of the construction site, employees who worked without fall protection were exposed to a fall hazard of approximately 31 feet to the ground below.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used. On the north side of the construction site, employees worked over 6 feet without fall protection. The employees are to be retrained on fall protection by the employer.
