29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service and an employee was using it before repairs and tests necessary to render the equipment safe were made:  (a) On or about March 8, 2017, and at times prior, Phoenix Recycling, LLC. did not ensure that a baler showing evidence of damage on its electrical wiring was removed from service. The employer allowed employees to use the baler before repairs were made to render the equipment safe. In the main shop, a 110-V plug connected electrical/hydraulic baler was observed having damage on the electrical outer jacket. Damage was plainly visible from the control panel to the power distribution enclosure exposing employees to contact with electrical hazards.    Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
