29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial vehicle.  (a) American Baler Co. on or about March 21, 2017 at the address of 800 E. Center St. Bellevue, OH: The employer did not ensure employees operating forklifts were formally trained in the operation of power industrial vehicles. An evaluation of competency for the employee operating the forklift was not conducted and documented by the employer. The observed operating employee and others working around the forklift were potentially exposed to struck-by injuries due to operation by an unevaluated operator.

Center St. Bellevue, OH: The employer did not ensure forklifts were examined/inspected daily to detect any condition in which would adversely affect the safety operation of the vehicle before being placed in service. Employees operating the units in this condition were exposed to potential injuries associated with equipment malfunctions.

Center St. Bellevue, OH: The employer did not ensure welding operations were performed in a booth enclosure or behind arc welding screen(s).  The eyes of employees walking/working in or near these operations were exposed to welding rays.
