29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. There was no frequent and regular inspections being performed by a competent person to ensure the job-site, materials and equipment such as residential fall protection systems and/or devices were being maintained and utilized in a safe condition. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

1926.21(b)(2): "Safety training and education". The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. Located on the north side of a commercial structure, employees were observed performing wall erection while standing at the unprotected edge that were not trained in their language of origin (Spanish) and/or presented information in a manner that employees could understand how to minimize those hazards. Potential fall height was measured to be greater than 23 feet above the hard ground below while not utilizing a fall protection system.

29 CFR 1926.501(b)(1): "Unprotected sides and edges". Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Located on the north side of a commercial structure, employees were exposed to a fall hazard while performing wall erection at the unprotected edge of a third story floor area while not utilizing a fall protection system. Potential fall height was measured to be greater than 23 feet above the hard ground below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
