OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being thrown from, pinned under, or crushed by a powered industrial truck (forklift) when operating the equipment without a seat belt:  a) Jobsite: On March 23, 2017 and at times prior thereto employees used a GEHL rough terrain forklift to support a scaffold platform. The rough terrain forklift was driven and parked on the north/front side of the structure.  Employees are not required to use the seatbelt.  The seatbelt was not easily accessible, in that it was underneath and behind the operators seat.    Note) Certification of corrective action is required for this item.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:   a) Jobsite: On March 23, 2017 and at times prior thereto employees performed faming activities from a scaffold platform that was supported by a rough terrain forklift.  The scaffold platform was not designed and constructed by a qualified person in that the platform was not secured to the forklift. The employees were exposed to an approximate 14 foot fall to the ground below.  b) Jobsite: On March 23, 2017 and at times prior thereto employees performed faming activities from a scaffold platform that was supported by a rough terrain forklift.  The scaffold platform was not designed and constructed by a qualified person in that a guardrail system or other fall protection system was not in place.  The employees were exposed to a 14 foot fall to the ground below.  c) Jobsite: On March 23, 2017 and at times prior thereto employees performed faming activities from a scaffold platform that was supported by a rough terrain forklift.  The scaffold platform was not designed and constructed by a qualified person in that the manufacturer warned of a personal injury hazard, prohibiting use of the machine as a personal lift, or to fit the machine with any form of personnel work platform.  The employees were exposed to a 14 foot fall to the ground below.  Note) Certification of corrective action is required for this item.
