29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) Front Side - On or about March 27, 2017, workers were putting slate on the front side of a house while working from a ladder jacket scaffold without using fall protection and were exposed to a 19 feel fall hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: (a) Jobsite - On or about March 27, 2017, workers were putting slate on the front wall while working from a scaffold without using fall protection and they had not received scaffold training. (b)1st to 2nd Floor - On or about March 27, 2017, employees used a stairway with 16 risers missing its stair rail and handrail to access their work area on the rooftop. (c) 2nd to 3rd Floor - On or about March 27, 2017, employees used a stairway with 15 risers missing its stair rail and handrail to access their work area on the rooftop. (d) 3rd to Roof Access - On or about March 27, 2017, employees used a stairway with 17 risers missing its stair rail and handrail to access their work area on the rooftop. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
