29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Employees applying shingles to a two (2) story apartment complex roof were exposed to fall hazards.

CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: (a) Employees using a 24-foot extension ladder on the East side of the home that did not extend 3-feet above the landing of the roof were exposed to a fall hazard. (b) Employees using a 24-foot extension ladder on the West side of the home that did not extend 3-feet above the landing of the roof were exposed to a fall hazard.
