29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)   TLC Pipeline Construction Inc., located west of 64 Cliff View Circle, Parachute, CO 81635:  On and before March 29, 2017, the employer did not ensure that employees were protected from injury, in that the spoil pile was placed at the edge along one side of the excavation.  Employees were installing a new pipeline in the excavation that was approximately 10 feet deep, 20 feet wide, and more than 30 feet in length.  This condition exposed the employees to the hazard of the materials falling into the trench or causing the trench to collapse.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart:      (a) TLC Pipeline Construction Inc., located west of 64 Cliff View Circle, Parachute, CO 81635:  On or before March 29, 2017, the exposing employer did not ensure that each employee working inside a trench that was approximately 10 feet deep, 20 feet wide, and more than 30 feet in length was protected from cave-in, in that the excavation was sloped at an angle greater than the 45 degree maximum allowable slope for type B soil.  This condition exposed employees to a crushing hazard by trench wall cave-in.
