29 CFR 1910.27(a): (a) Scaffolds. Scaffolds used in general industry must meet the requirements in 29 CFR part 1926, subpart L (Scaffolds). On April 10, 2017 located on the exterior structure of the Shop at Harpers Point, an employee working for Towne Properties Asset Management Company was observed working inside JLG articulating telescopic boom lift without a body belt/harness and lanyard attached to the boom or basket while exposed to a fall hazard approximately 25 feet above the ground below.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On April 10, 2017 located on the exterior structure of the Shop at Harpers Point, an employee working for Towne Properties Asset Management Company was observed working inside JLG articulating telescopic boom lift without a body belt/harness and lanyard attached to the boom or basket while exposed to a fall hazard approximately 25 feet above the ground below.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: On April 10, 2017 located on the exterior structure of the Shop at Harpers Point, an employee operating a JLG articulating telescopic boom lift had not receive training to recognize the hazards associated with the type of aerial lift being used and to understand the procedures to control or minimize those hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
