29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Establishment: Employer had not developed and implemented a written Hazard Communication Program for employees who were exposed to hazardous chemicals such as abrasive blasting agents (Maxi-Blast 30-60 Eurogrit and Silica Sand), Blaster Parts Washer solvent, and acetone that included labeling requirements, safety data sheets, and employee training.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: Yard: Employer had not developed and implemented a respiratory protection program for employees who use respirators such as Bullard supplied air respirator for protection against airborne contaminants such as silica during abrasive blasting operations and elastomeric half mask respirator for protection against solvents. Elements required by this section included, but were not limited to, procedures for selecting respirators for use in the workplace, procedures for proper use of respirators, and training of employees in the respiratory hazards to which they are potentially exposed.
