29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) The employer did not establish and implement those elements of a written respirator program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator. The Graphics Department employee was not medically evaluated prior to respirator usage. (b) The employer did not establish and implement those elements of a written program necessary to ensure that the respirator was cleaned, stored, and maintained so that it's use does not present a health hazard to the user. The respirator used by the Graphics Department employee was stored unprotected on a shelf in a walk-in custodial supply closet exposing it to possible chemical contamination.

29 CFR 1910.1200(e)(1)(i): A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and, (a) A list of chemicals present was not generated. Chemicals are stored in flammable cabinets, a janitorial/supply cabinet and room, on shelves in various work areas and in drums. Also used were squirt bottles containing glues and solvents, such as naphtha and acetone, used by employees in the main work area and in the sign department.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) Employees were not trained on the use of the Globally Harmonized System (GHS) of Chemical Classification and the associated pictograms, signal words and other warnings found on labels and Safety Data Sheets (SDS) to inform employees of chemical hazards.
