29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:       On or about April 13, 2017, In the Administration Building, a fire exit door located in the west side of the lunch room was obstructed due to the door being two feet above the existing outside surface without the presence of stairs and a recreational boat trailer was positioned just outside the exit there by exposing employees to a fall hazard. In addition, the fire exit door is approximately five feet tall there by exposing employees to a struck by hazard.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:     On or about April 13, 2017,  a Yale forklift, model number GLP050TGE85, serial number A875B03345W, modified with a locally manufactured ball hitch attachment was being used without the manufacturer's written approval to move a 34' foot pleasure boat loaded on a hydraulic trailer to the launch area thereby exposing employees to struck by crushing hazards. Additionally, there is a ball hitch located at the tip of the fork tines.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  29 CFR 1910.178(l)(2)(ii) is applicable to shipyard employment by 29 CFR 1915.120 that incorporates the general industry requirements.    On or about April 13, 2017, employees required to operate forklifts were not provided training on the safe operation of forklifts that included formal instruction, practical training and an evaluation of the operator's performance in the workplace.
