OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards, such as falls that were causing or likely to cause death or serious physical harm to employees: a) Destefano Foods, Inc. / 561 Jersey Avenue, New Brunswick, NJ site - warehouse: Employees exposed to a falling hazard while being raised on the forks of Hyster forklift trucks to the top racks when picking product approximately 9-10 feet up. Condition noted on or about 10/22/2014.

29 CFR 1910.176(b): Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse: a) Destefano Foods, Inc. / 561 Jersey Avenue, New Brunswick, NJ site - warehouse: Storage of material created a hazard. Employees were exposed to struck by hazards of collapsing racks of the metal storage racking system while the employees warehoused materials. Industrial steel storage racks which were bent or damaged and were used for storage of pallets containing various sized containers of product. Condition noted on or about 04/10/207.
