29 CFR 1926.62(d)(2)(i): Until the employer performed an employee exposure assessment as required in paragraph (d) of this section and documented that the employee performing any of the listed tasks was not exposed above the PEL, the employer did not treat the employee as if the employee were exposed above the PEL, and not in excess of ten (10) times the PEL, and did not implement employee protective measures prescribed in paragraph (d)(2)(v) of this section: Location: barn/garage On or about 4/14/17, the employer did not treat employees who were manually scraping paint containing lead as if they were exposed to lead above the PEL and additionally did not provide protective measures until an initial exposure assessment had been conducted.

29 CFR 1926.62(d)(2)(v): Prior to the performance of an employee exposure assessment as required under paragraph (d) of this section, the employer did not provide to employees performing the tasks described in paragraphs (d)(2)(i) through (d)(2)(iv) of this section with interim protection, as indicated in paragraphs (d)(2)(v)(A) through (d)(2)(v)(F): Location: barn/garage On or about 4/14/17, the employer, prior to conducting a exposure assessment for lead, did not provide employees who were manually scraping paint containing lead, protections including: 1. appropriate personal protective clothing, 2. change areas for clothing, 3. biological monitoring consisting of blood sampling and analysis for lead and zinc protoporphyrin levels.' 4. training on hazards of lead and use of respirators, 5. respiratory protection, such as, a dust respirator approved by NIOSH for lead protection.
