29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) At the facility, an employee who operated a company fork lift truck to move heavy parts and supplies into and out of the parts shop had not received the training required by 29 CFR 1910.178(l).

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. a) At the establishment, employees exposed to contact and inhalation hazards from the chemicals they used had not received information and training on those chemicals. The chemicals included, but were not limited to, Plastic Abrasive Part # 6712, Rust-Oleum Aerosol Paints, VHT Nite-Shades Lens Aerosol Paints, and Safety-Kleen Premium Solvent.
