29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) On or about 04/18/17, on the roof of a one story commercial building located at 2976 Seneca St., West Seneca , NY: One employee was on the flat roof portion of the building using a Caulking gun to caulk the heads of nails on the backside of the cap around the roof perimeter. The employee was exposed to a fall of approx. 12 ft. from the eaves at the bottom of the steep Mansard portion of the roof around the building to the ground. No fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 04/18/17, on the roof of a one story commercial building located at 2976 Seneca St., West Seneca , NY: One employee engaged in roofing work was exposed to a fall of approx. 12 ft. because the siderails of the extension ladder used to access the upper flat roof were flush with the mansard roof and did not extend above the flat portion of the roof. In fact, the siderails of the ladder were about 8 inches below the flat roof surface. NO ABATEMENT CERTIFICATION REQUIRED
