29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) At 831 South Three Notch St., Troy, Alabama: On or about April 25, 2017 and at times prior; the controlling employer Development Consulting allowed its employee and subcontractor I and M General Construction employees operate a Powered industrial truck on the job site without first ensuring the employees were trained exposing the employees to struck-by hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At 831 South Three Notch St., Troy, Alabama: On or about April 25, 2017 and at times prior; the controlling employer Development Consulting allowed its subcontractor I and M General Construction employees to use a job made ladder to gain access to the second floor of the building and the rails of the ladder did not extend at least three feet above the landing area exposing subcontract employees to a fall hazard of 11.4 feet to the ground below.
