29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. [General Industry reference 29 CFR 1910.27 (a)]. a) Platinum Maintenance Service Corp., employees', working on tubular welded frame scaffold, at 10 Columbus Circle New York, NY 10019, was exposed to falling hazard from approximately 12 feet height. The employee was not using fall arrest system or guardrail. The condition was noted on or around 05/03/17. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.451(e)(4)(i): A stairrail consisting of a toprail and a midrail was not provided on each side of each scaffold stairway.[General Industry reference 29 CFR 1910.27 (a)]. a) Platinum Maintenance Service Corp., employees', working on tubular welded frame scaffold, at 10 Columbus Circle New York, NY 10019, was exposed to falling hazard while using the starway of a scaffold. The stairway was not provided with guardrails. The condition was noted on or around 05/03/17. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
