29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about at 5/8/17 located at 201 Oakland St., Cumming, GA: Employees were reroofing and installing roofing shingles on to the apartment duplex being reroofed while on top of the roof approximately 35  foot from the lower level. The employee on the roof was observed throwing down to the ground the excess shingles while the other employee was  underneath him and had a near miss of being struck in the head without hard hats exposing them to a struck by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    On or about at 5/8/17 located at 201 Oakland St, Cumming, GA: Employees were observed reroofing and installing roofing shingles on the roof of a apartment duplex while working at the edge, the employer did not ensure that fall protection was used by the employees while exposed to fall hazards of approximately up to 35- feet on the 8/12 pitch roof.
