29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  (a) At a residential construction site located at 6820 Holmes Rd in Kansas City, MO: Employees were exposed to harmful chemicals that could cause injuries and/or illnesses in that the employer had not developed, or successfully implemented, an effective hazard communication program. This was demonstrated on 5/5/2017 at the residential construction site when 4 employees were exposed to a mislabeled canister of kerosene. The canister was labeled and intended for kerosene, but actually contained gasoline.

29 CFR 1926.21(b)(2): The employer should instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a) At a residential construction site located at 6820 Holmes Rd in Kansas City, MO: Employees were exposed to potentially serious injuries and/or illnesses in that the employer had not developed, or successfully implemented, an effective safety and health program. The employer failed to train their employees on the recognition of hazards associated with falls as was demonstrated on 5/5/2017 when 4 employees were exposed to fall hazards while working from a roof and had not been trained in the regulations applicable to their work.

29 CFR 1926.102(a)(1): The employer should ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) The employer failed to provided employees who were exposed to struck-by hazards appropriate eye protection. This was documented on 5/5/2017 at the residential construction site located at 6820 Holmes Rd in Kansas City, MO. Employees were observed working without eye protection while using pneumatic nail guns and hammers without the use of any means of eye protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) At the residential construction site located at 6820 Holmes Rd in Kansas City, MO:  Employees were exposed to fall hazards while working on a roof without the use of fall protection. This was demonstrated on 5/5/2017 when employees were allowed to work  from an approximate distance 9. feet on the south side, and over 25 feet on the highest point of the north side, and 11 feet on the east side to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) The employer failed to provided safe access to employees at a residential construction site located at 6820 Holmes Road, Kansas City, MO 64131, when employees were using portable ladders to gain access to a roof. This was demonstrated on 5/5/2017 when 3 separate ladders were being used to gain access to various portions of the site and the ladders were not placed at least 3 feet above the upper landing, nor were they secured.
