29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in the workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer: On or about 9 May 2017, and at times prior, the employer did not ensure that each of the following provisions were established and implemented in the respiratory protection program where employees are required to wear respirators: 1910.134(c)(1)(i)-Procedures for selecting respirators for use in the workplace; 1910.134(c)(1)(ii)-Medical evaluations of employees required to use respirators; 1910.134(c)(1)(iii)-Fit testing procedures for tight-fitting respirators; 1910.134(c)(1)(iv)-Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; 1910.134(c)(1)(v)-Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding and otherwise maintaining respirators; 1910.134(c)(1)(vi)-Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; 1910.134(c)(1)(vii)-Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; 1910.134(c)(1)(viii)-Training of employees in the proper use of respirators, including putting on and removing the, any limitations on their use, and their maintenance; and 1910.134(c)(1)(xi)-Procedures for regularly evaluating the effectiveness of the program.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards of combustible dust deflagration, fire and explosion which are causing or likely to cause death or serious physical harm to employees: On or about 9 May 2017 and at times prior, employees working to mill and package a plant product, Mitragyna speciosa, also known as Kratom, were exposed to a fire hazard while using a dust collection system connected to PVC piping, small cyclones and a dust collector, without interconnecting the system for static electricity continuity.
