29 CFR 1926.1101(h)(3)(iv)(A): The employer did not provide employees with a tight fitting powered air-purifying respirator equipped with high efficiency filters, or full facepiece supplied-air respirator operated in the pressure demand mode equiped with HEPA egress cartridges, or full facepiece supplied-air respirator operated in the pressure demand mode equipped with an auxiliary positive pressure self-contained breathing apparatus when employees were in a regulated area where Class I work was being performed, for which a negative exposure assessment of the area was not available, and the exposure assessment of the area indicated the exposure level would not exceed 1 f/cc as an 8-hour time average:  (a) Pristine Environmental LLC, at 822 S Oneida Street, Unit F109, Denver, CO: On or about 5/9/17 and 5/10/17, the employer did not provide employees with a tight fitting powered air-purifying respirator equipped with high efficiency filters, or full facepiece supplied-air respirator operated in the pressure demand mode equipped with HEPA egress cartridges, or full facepiece supplied-air respirator operated in the pressure demand mode equipped with an auxiliary positive pressure self-contained breathing apparatus when employees were in a regulated area where Class I work was being performed, for which a negative exposure assessment of the area was not available, and the exposure assessment of the area indicated the exposure level would not exceed 1 f/cc as an 8-hour time average.  Employees removed thermal system insulation (TSI), scraped surface texture from a closet ceiling, and removed drywall containing skim coat/joint compound with 10% chrysotile asbestos.  The TSI and surface texture are presumed asbestos containing materials.  These operations were Class I asbestos work.  The work was conducted in a regulated area.  The employer did not have a negative exposure assessment for the removal of the TSI or scraping of the ceiling surface texture.  Two employees wore North tight fitting air purifying half face piece respirators with P100 filters.  One employee wore a North tight fitting air purifying full face piece respirator with P100 filters.  This condition potentially exposed employees to an asbestos hazard.
