29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: (a) New residential construction located on Lot #3, Roadway in front of Lot #3: On or about May 9, 2017, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns at 120 PSI, in that protective eyewear was not provided to employees framing roof trusses. (b) New residential construction located on Lot #3, Second floor top plate: On or about May 9, 2017, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns at 120 PSI, in that protective eyewear was not provided to employees engaged in framing activities.

29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: (a) New residential construction located on Lot #3, Front side of structure: On or about May 9, 2017, and at times prior, the employer exposed employees to amputation hazards while working in close proximity to unguarded moving parts of the air compressor, in that the belt guard and the starter recoil cover were not on the equipment as employees were using an air compressor for framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located on Lot #3, Second floor top plate: On or about 05/09/2017, and at times prior, the employer exposed employees to fall hazards of 20-feet, 8-inches to the lower ground level, in that, a fall protection system was not provided to employees engaged in framing activities using the top plates as a walking/working surface.
