29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located on Lot #15, Front porch roof: On or about May 26, 2017 and at times prior, the employer exposed an employee to fall hazards of 21-feet while working from a 3/12 pitched roof, in that a fall protection system was not provided to an employee engaged in framing activities.

29 CFR 1926.503(a)(2)(i): Employees were not trained, as necessary, by a competent person qualified to recognize the nature of fall hazards in the work area: (a) New residential construction located on Lot #15: Second level porch roof: On or about 05/26/2017, and at times prior, the employer failed to train employees to recognize fall hazards, in that employee was not aware of when fall protection was needed and how to minimize the risks of these fall hazards as training by a qualified person was not provided.
