29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) (a) At a residential construction site located at 400 Appaloosa Dr in Raymore, MO: Employees were exposed to harmful chemicals that could cause injuries and/or illnesses in that the employer had not developed, or successfully implemented, an effective hazard communication program. This was demonstrated on 6/6/2017 at the residential construction site when 4 employees were exposed to gasoline that was used to power the pneumatic air compressor.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) At a residential construction site located at 400 Appaloosa Dr. in Raymore, MO: Employees were exposed to potentially serious injuries and/or illnesses in that the employer had not developed, or successfully implemented, an effective safety and health program. The employer failed to train their employees on the recognition of hazards associated with falls as was demonstrated on 6/2/2017 when 6 employees were exposed to fall hazards while working from a roof and had not been trained in the regulations applicable to their work.

This was demonstrated on 6/2/2017 when employees were allowed to work from an approximate distance 9 feet on the eve of the roof to the ground below, and over 16 feet on the highest point to the ground below. DM ENTERPRISE was previously cited for the same violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) as contained in Inspection: No. 1199379, Citation 1, Item 2, issued on January 31, 2017, at a jobsite located at 3708 SW 11th St, Blue Springs, MO.

This was demonstrated on 6/6/2017 when a ladder was being used to gain access to the roof and the ladder was not placed at least 3 feet above the upper landing.
