29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  (a.) Saw Area: On or about 6/7/17, the employer exposed employees to continuous noise at 80% of the permissible daily exposure of 85 dBA (8hours time weighted average) or an equivalent sound level of 88.3 dBA during the 240 minute sampling period. The exposure calculation included a zero increment for the 240 minutes not sampled. The initial baseline sampling was not conducted by the employer.

29 CFR 1910.95(g)(5): 29 CFR 1910.95(g)(1):  The employer did not establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a)  Extrusion Department- On or about 6/7/17, the employees were exposed to noise hazards, in that audiometric testing was not provided to employees while performing task such as but not limited to fabrication.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the  safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  (a) Warehouse: On or about 6/7/2017, the employees were exposed to skin and eye irritations hazards, in that hazard communication training on the new labeling requirements and safety data sheet format was not provided to employees while utilizing hazardous materials such as lacquer thinner.
