29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Workplace, 100 Park Plaza Drive, Secaucus, NJ a) On 6-12-17, the employer failed to ensure that a carpenter installing roof parapet trusses at the edge of the 5th floor, was protected by the use of guardrail system, safety net system, or personal fall arrest system. The carpenter failed to use a personal fall arrest system, wearing only a harness which was not attached to a lifeline or anchoring devices and fell approximately 54 feet to the ground below, dying from his injuries. b) On 6-12-17, employees performing framing and installation of roof parapet trusses used an extension ladder from the 5th floor to the 5th floor roof level of the building. Such workers were exposed to fall hazards of 10 feet as neither guardrails nor personal fall arrest systems were used after they accessed the 5th floor roof level of the building.

29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person: workplace, 100 Park Plaza Drive, Secaucus, NJ a) A carpenter's helper was exposed to fall hazards of up to 54 feet to ther ground below when using a personal fall arrest system consisting of a 00455 Guardian D-Ring Temper Anchor, a retractable lifeline, and full body fall arrest harness. The Guardian D-Ring Temper Anchor was improperly installed, in that, only a total of six (6) #10 nails (3 nails per metal flap) were used to secure the ring to the decking. According to the manufacturer, the minimum number of fasteners required to achieve the 5,000 pound anchor strength, is a total of twelve (12) 16d nails (6 nails down the center of each metal flap). Violation occurred on or about 6-12-17

29 CFR 1926.1052(b)(2): Skeleton metal stairs where permanent treads and/or landings were to be installed at a later date, were not fitted with secured temporary treads and landings long enough to cover the entire tread and/or landing area and foot traffic: Workplace, 100 Park Plaza Drive, Secaucus, NJ a) Employees performing framing and installing roof parapet trusses on the roof level of a 5 story building accessed the Phase D work area via a metal skeleton stairway A in Building 200. On the 3rd floor the metal skeleton stairway pan was not filled with lumber, and the employees when walking down the stairway were exposed to trip and fall hazards to the intermediate landing between level 3 and 2. Violation occurred on or about 6-12-17
