29 CFR 1910.134(c)(3): The employer did not designate a program administrator who was qualified by appropriate training or experience to administer or oversee the respiratory protection program and to conduct the required evaluations of program effectiveness:  (a) On or about 6/21/17 at Westside Rifle & Pistol Range Inc. located at 20 West 20th Street New York, NY 10011. The employer failed to designate a program administrator within the respiratory protection program for employees who voluntarily wear 3M tight-fitting respirators while sweeping up brass shell casings within the shooting range.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER  IS REQUIRED TO SUBMIT ABATEMENT  DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) On or about 6/21/17 at Westside Rifle & Pistol Range Inc. located at 20 West 20th Street New York, NY 10011. The employer failed to medically evaluate employees prior to use who voluntarily wear 3M tight-fitting respirators while sweeping up brass shell casings within the shooting range.
