29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New townhome construction on Lot #251, Roof: On or about June 8, 2017, and at times prior, the employer exposed employees to fall hazards while working from a 7/12 pitched roof at eave heights of 30-feet, 7-inches, in that a fall protection system was not provided to employees engaged in painting the dormers.

29 CFR 1926.1053(a)(7): Ladders not designed for such use were tied or fastened together to provide longer sections:  (a) New townhome construction located on Lot #251, West gable side: On or about June 8, 2017, and at times prior, the employer exposed employees to fall hazards of over 30-feet, in that a 14-foot ladder fly section was tied to a 40-ft. aluminum ladder to paint the rake boards on a 3-story townhome.   (b) New townhome construction located on Lot #251, Front side: On or about June 8, 2017, and at times prior, the employer exposed employees to fall hazards of over 20-feet, in that a 32-ft. ladder was extended past the lock assembly and the extension of the ladder was held in place by ropes which increased the height of the ladder to paint the window trim.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  (a) New townhome construction located on Lot #251, West gable side: On or about June 8, 2017, and at times prior, the employer exposed employees to collapse/fall hazards of over 30-feet from the lower level, in that the ladder side rails were damaged and the ladder foot pads were missing at the bottom of the ladder being used to paint the rake boards.
